The Department of Homeland Security is considering making changes to the E-Verify program that could impact the ever-increasing number of participating employers, adding additional obligations.
E-Verify is the U.S. Citizenship and Immigration Service (USCIS) web-based service that employers use to confirm their new hires are authorized to work in the US. It compares information from an employee’s Form I-9 against data from U.S. Department of Homeland Security and Social Security Administration (SSA) records to confirm employment eligibility.
We are closely tracking the proposed changes and all E-Verify updates and are prepared to ensure our customers remain compliant through the transition. Until DHS announces the final changes and the implementation dates, employers should follow the existing program.
The most significant of the proposed changes would require participating employers to use E-Verify to re-verify the employment authorization for those employees whose temporary work authorization expires. This new obligation would apply to employees who were hired before the employer enrolled in E-Verify and began verifying new hires.
The proposed changes are summarized in greater detail here.
